Below you find the eWork User Agreement. By accepting these terms, you approve our rules for you handle information and contacts on our website.
1 Introduction
This user agreement regulates the obligations and rights between users of this service and eWork.
2 Definitions
A User is defined as the person who has registered on the eWork website and has a username and password which gives access to the services provided by eWork.
3 Registration
Users can join eWork by registering at the eWork website on the Internet, below called the website. To register, a user has to enter valid registration information and accept this agreement. To complete the registration, this agreement has to be accepted.
4 The User's obligations
4.1 The User's responsibilities for personal information
According to the Swedish Law "Personuppgiftslagen (1998:204)", no processing or storage of personal information may take place without the person's acceptance. By accepting this user agreement, the user accepts that eWork store and process the information the user has registered at eWork. The user is responsible for the validity of the information.
The eWork matching service is based on a database where information on consultants and projects are stored and matched against eachother. To be able to provide this service, eWork reserves the right to transfer the information to a third country (country outside the EU and EES). Processing the personal information over the Internet means that the information can be accessed anywhere in the world. By accepting this user agreement, the user accepts that eWork transfer, store and process personal information to a third country. The user also accepts that the information is transfered and accessible over the Internet.
4.2 Responsibilities for information
The user accepts to not publish any information violating other person's rights, laws, constitutions, information considered offensive to eWork or any third party. The latter means that the information may not contain agitation against an ethnic group, pornography or violence and the material may not include anything that is against the law.
eWork has the right, but is not obliged to, review the user's activities on the website and the information entered on the website by the user. eWork has the right to remove any information violating the terms in this agreement.
4.3 Responsibilies for Username and Password
If the user suspects that his username and password is illegally used, the user shall notify eWork. The user is obliged to make sure that his user identification is used with secrecy, avoiding unauthorized use of this identification. The user is responsible for the usage of the services under the user's identification until the user notifies eWork that the account shall be closed. Closing the user's account shall be notified to eWork through email.
5 Limitation of responsiblities
5.1 eWork's responsibilities according to these terms is limited, meaning that the user can only be compensated for costs caused by eWork where it can be proven that eWork has been severely reckless or has caused damage by illegal intent. eWork's total liabilities towards the user or his customers according to this agreement is limited to the financial amount eWork has received from the user for the services provided, unless eWork has been severely reckless or has acted with illegal intentions.
5.2 The user does not have any rights to compensation for indirect costs, damages, loss of production and other losses like loss of expected cost cuts, expected profits or any other indirect loss, even if eWork has been informed that there is a risk for losses of this kind, eWork is free of responsibilities for this costs caused by circumstances presented in item 6 below.
5.3 Claims of compensation can not be held if claim havent been raised within 6 months from the day the user became aware or should have been aware of the circumstances the claim is based upon. The user can not make any other claims towards eWork than whats stated in these terms.
5.4 eWork is not responsible for the relation between buyer and seller of the consultant services, eWork act only as a neutral broker of assignments and consultants on the website. eWork does not take responsibility for the quality of performed work or the correctness of the consultant profiles registered on the website.
6. Base of exemption
eWork is not responsible for any loss or damage which has been caused by reasons out of eWork's control. eWork is not responsible for damages or losses for the user if those are caused by limitations in the access to our services due to actions taken by eWork for technical, or maintenance resons.
7 Termination/deactivation of user accounts and user profiles
eWork has the right to without notice, shut down the user's account on the website if the user is using the website in an unlawful manner or is causing damage or risk of damage to eWork or a third party, or if the user is not acting according to the terms given in this agreement.
If the user does not use the services by logging in on the website during sixty (60) days, eWork has the right to deactive the user's profile(s).
8 Links
The website contains links to other websites. eWork provide these links only as a service to eWork's users. eWork is not responsible for the availability, content, commercials, products or other material available on these third party websites. eWork cannot be held responsible for any damage or loss caused by the usage of these external websites.
9 Immaterial rights
All immaterial rights and technical solutions, etc regarding eWork Scandinavia AB are eWork's property, or propery of a third party by which eWork has an agreement, and may not be used by the users in any way not accepted by eWork.
10 Hosting
eWork has the right to take measures which affects the accessibility if it is necessary of technical, support- or hosting reasons.
11 Functionality and design of the service
eWork has the right to change the functionality and design of the services provided on the website.
12 Transfer of agreement
A user's registration cannot be transfered to another user. eWork has the right to transfer all or some of the rights and obligations to a third party. eWork has the right to contract a third party to fullfil our obligations.
13 Update of agreement terms
eWork has the right to update and change the terms in this agreement. It is the user's responsibility to be updated on the current agreement terms. eWork has always the right to do these changes without notice if it is required by law, constitution or decision by authorities.
14 Other
In case any of these terms is invalid, this shall not affect the other terms or the full agreement. The invalid term shall be replaced by a valid term as far as possible according to the intentions by the original term.
15 Law and dispute
This agreement is set up under Swedish Law. Any dispute from this agreement shall, if disputed amount is less than 15 base amounts (basbelopp) according to law (1962:381) of public insurance, or if the user has used the service for private use, be solved by public court of law. If the dispute is on an amount larger than 15 base amounts (basbelopp) the dispute shall be solved by arbitration according to the rules of the Stockholm Handelskammare Skiljedomsinstitut. The matter shall be solved in Stockholm and in Swedish.
